01 Acceptance

If you do not agree, do not use the Fit App. If you use the app on behalf of a minor, you represent that you are their parent or guardian and consent on their behalf.

02 Definitions

• "Fitness centre" — the fitness facility that subscribed to Pace and invited or enrolled you.
• "Member" — you, an individual linked to a Fitness centre through the Fit App.
• "Pace Admin" — the management app and platform your Fitness centre uses (dashboard, members, gate, billing integrations).
• "Rank / Leaderboard" — gamification features configured by the Fitness centre, displayed in the Fit App.

03 The service

Pace Fit lets Members view attendance-based streaks and ranks, participate in fitness centre leaderboards, keep an optional training journal, use recovery-style wellness prompts, and stay connected to a Fitness centre on Pace Admin. Features vary by Fitness centre and subscription tier.

We may update, add, or remove features. We do not guarantee uninterrupted availability; maintenance and third-party outages may occur.

04 Eligibility & fitness centre relationship

You may use the Fit App only if:

• Your Fitness centre uses Pace and has enabled member access for you;
• You complete OTP or invite verification we provide; and
• You remain in good standing with your Fitness centre's membership rules.

Your Fitness centre membership contract (fees, freeze, cancellation, facility rules) is solely between you and the Fitness centre. Pace is not a party to that contract.

05 Account & security

You are responsible for keeping your device and OTP verification secure. Notify your Fitness centre or support@aureus.app if you suspect unauthorised access. You may link only to Fitness centres where you have a legitimate membership.

06 Acceptable use

You agree not to:

• Manipulate check-ins, streaks, or leaderboard data (including sharing accounts or spoofing attendance);
• Harass, threaten, or post unlawful content in journal or social features;
• Reverse engineer, scrape, or overload our APIs except as permitted by law;
• Use the app for any purpose unrelated to personal fitness centre membership;
• Circumvent technical limits or another Member's privacy.

We and your Fitness centre may investigate suspected abuse and suspend access.

07 Ranks, streaks & leaderboards

Rank names, thresholds, and leaderboard rules are set by your Fitness centre in Pace Admin. Pace displays them in good faith but does not adjudicate Fitness centre disputes about rank or prizes. The Fitness centre's staff decisions on membership and access are final for Fitness centre-controlled policies.

09 Intellectual property

The Fit App, Pace branding, software, and design are owned by Pace or licensors. You receive a limited, non-exclusive, revocable licence to use the app for personal, non-commercial membership purposes. You retain ownership of content you create (journal entries); you grant us and your Fitness centre a licence to host and display that content as needed to operate the service.

10 Privacy

Our Privacy Policy describes how we process personal data. Fitness centre operators should also read the platform Privacy Policy and platform Terms.

11 Suspension & termination

We may suspend or terminate your access if you breach these Terms, if your Fitness centre removes you from Pace Admin, or if required by law. You may stop using the app at any time. Provisions that by nature should survive (disclaimers, liability limits, governing law) survive termination.

12 Disclaimers

The Fit App is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant error-free leaderboards or that the app will meet every Fitness centre's expectations.

13 Limitation of liability

To the maximum extent permitted by Indian law, Pace and its directors, employees, and suppliers are not liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or goodwill arising from your use of the Fit App.

Our aggregate liability for claims relating to the Fit App in any 12-month period is limited to the greater of (a) INR 5,000 or (b) amounts you paid directly to Pace for the Fit App in that period (typically zero, as the app is provided to Members via the Fitness centre).

Nothing in these Terms limits liability that cannot be limited under applicable law (including fraud or wilful misconduct).

14 Indemnity

You will indemnify and hold Pace harmless from claims arising from your misuse of the Fit App, your violation of these Terms, or your violation of third-party rights, except where caused by our gross negligence or wilful misconduct.

15 Changes to these Terms

We may modify these Terms. We will post the updated version with a new "Last updated" date and, where changes are material, provide notice in the app. Continued use after the effective date constitutes acceptance.

16 Governing law & disputes

These Terms are governed by the laws of India. Courts at Ernakulam, Kerala have exclusive jurisdiction, subject to mandatory consumer protections and any dispute resolution process your Fitness centre separately agrees with you.
